| American Bike Rally Inc is a motorcycle
rally
service provider that specializes in rally information, merchandise, and travel
services. American Bike Rally Inc is not an official
coordinator, concessionaire, or vendor of any specific motorcycle rally. You will pay the lodging facilities,
tour operators, and merchandise vendors
according to their policies. Each lodging facility, tour operator, and activity vendor
may change its rates without notice. For our
reservation services, we charge a 10%
non-refundable reservation fee based
on the total dollar amount of the reservations that we make. The reservation fee,
billed separately to your credit card under the memo of "American Bike Rally", is only assessed if we are able to obtain the
reservations you request. The reservation fee may increase if you add rooms, add
nights, add activities, or otherwise increase the total dollar amount of your original
reservation. The reservation fee is non-refundable and it is not reduced even
if you reduce the length of your stay. If you
need to cancel a reservation, you must contact our office directly by phone or
e-mail. American Bike Rally Inc is not responsible for room deposits
and/or costs associated with a lodging or activity reservation.
Any disputes over room or other reservation deposits must be
resolved between you and the hotel facility, activity vendor, or concessionaire. We
only cancel reservations that were originally made through our call center or
website.
If you submit an online reservation order form via our website (www.americanbikerally.com), our office will send an
e-mail confirmation within 48 hours except for reservation orders placed on
Fridays or during a
weekend, in which case you will receive an e-mail confirmation on the following
Monday. The e-mail confirmation will be sent
to the address that you provide on the online reservation request form. If you enter
an incorrect e-mail address, then we will make an effort to confirm the reservation with you via telephone. However, if you
provide an incorrect e-mail address on the reservation form and our office is unsuccessful
in confirming the reservations by telephone, you agree to not hold American Bike
Rally Inc responsible. Once a reservation is completed, you may reply to
the e-mail confirmation or contact our office by telephone to request changes or
cancellations. If you fail to select a specific lodging option, then we
will automatically default your selection to "Any Location Available". You are responsible for reviewing the online order
carefully before clicking on the button titled "I Agree To The Terms --- Process My
Reservations" to submit your reservation order.
It is agreed between you and American Bike Rally Inc that all disputes and
matters whatsoever arising under or in connection with or incident to these
policies and procedures shall be litigated, if necessary, in and before a court
located in the State of Montana, USA to the exclusion of the courts of any other
state or country. An order acknowledgement is not a contract and does not
constitute an acceptance of your order, but only a record of your offer to
purchase a particular item at a particular price range. After you place an
order, American Bike Rally Inc will determine whether or not to fill the
order, and American Bike Rally Inc may refuse or limit your order for any
reason. By placing your order, you agree to accept all terms and conditions set
forth anywhere on this site, including the American Bike Rally terms and
conditions of sale. American Bike Rally Inc reserves the right to accept,
refuse, or limit your order for any reason, including, but not limited to,
declined credit card, the unavailability of a product or errors in the prices and
product descriptions posted on this web site. American Bike Rally Inc makes no
warranties, express or implied, including, but not limited to, any warranties of
merchantability or fitness for a particular purpose. In no event shall American
Bike Rally Inc be liable to a customer for any damages resulting from or
related to any failure or delay of American Bike Rally in providing the
services indicated herein.
We operate as a itinerary service, and are not the hotel or activity vendor.
Therefore, we cannot accept any liability for incidents occurring at the
property or relocation due to the hotel over booking. American Bike Rally Inc shall not be liable to a customer for any delays in the performance of services
hereunder or for any failure to perform hereunder if such delays or failure are
due to strikes, inclement weather, acts of God, or other causes beyond the
reasonable control of American Bike Rally. In no event shall American Bike Rally be liable to customer for any indirect, special or
consequential damages or lost profits arising out of or related to American Bike
Rally Inc services, the performance or breach thereof, or the accuracy
or correctness of the website or the information contained therein, even if
American Bike Rally Inc has been advised of the possibility thereof. American
Bike Rally's liability to any customer hereunder, if any, shall in no
event exceed the total amount customer paid to American Bike Rally Inc hereunder.
American Bike Rally Inc shall not be in any way responsible for
claims or damages caused by customer, through fault, negligence or failure to
perform customer's responsibilities, claims against customer by any other party,
or any act or omission of any party furnishing services and/or products.
American Bike Rally Inc is not responsible for
anything related to your lodging reservations, motorcycle rentals, tours, equipment
rental, or other tourist activities, including, but not limited to, guide
negligence, mechanical problems, road conditions, or accidents resulting in
property damage, injury, or death.
In the event that you dispute any/all charges for the services provided by
American Bike Rally Inc, please contact American Bike Rally Inc by replying
to the e-mail confirmation that you received from American Bike Rally Inc or
by contacting the American Bike Rally call center, and we will make every
effort to resolve your concerns. If you and American Bike Rally Inc cannot
agree on a solution and you choose to dispute any charges with your credit card
issuer, you agree to pay all legal, collection and administrative fees or any
other costs associated with collection of amounts due hereunder.
In chargeback attempts, we provide your credit card company a copy of the terms to which you
agreed when making a reservation. We also provide credit card companies with hard copies
of the reservation form and information that you submit to our office. All
online reservation forms are computer-stamped with the exact date and time of submission and the IP
address of the computer from which the form was submitted. American Bike
Rally, Inc reserves the right to
report any chargeback to the major consumer credit reporting and collection
agencies.
Our call center office is open from 8 a.m. to 6 p.m. (MST) Monday through Friday. Reservations can also be made online 7 days/week 24
hours/day by completing an online reservation form on our website (www.americanbikerally.com). Reservations made
online will receive an e-mail confirmation letter within 48 hours unless they
are placed on a Friday or weekend in which case a confirmation letter will be e-mailed
by the close of business on
the following Monday.
By clicking the "I Agree To The Terms --- Process My Reservations"
or "Submit" button, you are authorizing us to make your reservations
and charge your credit card for the non-refundable 10% reservation fee. In addition, you are
aware of and agree to all of the terms on this page.
